Thank you for visiting our website. The Australian Bike Vault - Stolen Bicycles Australia website is operated by Stolen Bicycles Australia Limited (ACN 610 835 802). The website is free to use and the majority of the functions of the website do not require a user to create an account. By accessing and/or using this website and related services, you agree to these Terms and Conditions, which include our Privacy Policy (available at www.stolenbikes.com.au/legal/privacy) (Terms). You should review our Privacy Policy and these Terms carefully and immediately cease using our website if you do not agree to these Terms.

In these Terms, 'us', 'we' and 'our' means Stolen Bicycles Australia Limited and our related bodies corporate.

1. Our Databases

We maintain a database of our registered members, their bicycles, details about the theft of their bicycles, as well bicycles where law enforcement are appealing for public assistance to identify and find the owner.

If you are a registered member, you may add, delete and/or modify information about you and any bicycles you register or post in our database.
If you become a registered member on another website with which we are associated, with your consent, we may:
(a) copy or transfer your information and information about your bicycle to another database we maintain; and
(b) link your registration on this website with your registration on the other website.

2. Create an Account

You must be over 18 years old to create an account. Certain services on our website require you to create an account before you can use them. These services include:

(a) registering a bike;
(b) transferring a bike;
(c) posting a stolen bike;
(d) posting a comment about a stolen bike;
(e) making a claim for a recovered bike posted by a law enforcement member; and
(f) receiving stolen bike email alerts.

Law enforcement members may access services which are not available to other members. These services include:

(a) posting a bike recovered by law enforcement; and
(b) accessing stolen bike posts and comments on the database upon request and when investigating a nominated stolen bike.

Public Members
When you register and activate your account, you will provide us with personal information such as your name, email address, state of residence and, optionally, telephone number. We may also require additional verification at our discretion. When you register and activate your account we will ask you to supply a password. Once your account is activated you will be assigned a member ID, which is our database number linked to your account. The email and password you supply are used to login and access your account. You are responsible for keeping your login email account, member ID and password secure and for all use under your account.

Bike Shop/Commercial Members
When you register and activate your account, you will provide us with your personal name, bike shop/business name, business address, email address and telephone number. You will also supply a password. We may also require additional verification at our discretion. We will assign you an account number and a verification code. Once your account is activated you will be assigned a member ID, which is our database number linked to your account. Your password, verification code, email account and account number are used to login and access your account. You are responsible for keeping your login email, password, verification code and member ID secure and for all use under your account.

Law Enforcement Members
When you register you will provide us with your name, work email address, information regarding your work location, your rank/position, employee number and work location phone number. We may also require additional verification at our discretion. Once your account is activated we will assign you a member ID, which is our database number linked to your account. To login and access our website you will supply a password and a verification code. You are responsible for keeping your email account, password, verification code and member ID secure and for all use under your account.

All members must ensure that information supplied upon registration is accurate and current. We will handle all personal information we collect in accordance with our Privacy Policy. If you believe your account has been compromised or misused, contact us immediately at admin@bikevault.com.au

3. Our services

Our services are intended to record bike identity and ownership pre- theft, publicise stolen and police recovered bikes and assist bike theft victims and police to locate, recover and reunite stolen bikes with their owners. In performing our services, we work closely with law enforcement. We may disclose your information to law enforcement to aid in their investigation.

You may access information on, or received information through, our website which enables you to locate your stolen bicycle and/or identify the person who stole it. You are to report such information to law enforcement and allow law enforcement to take appropriate action. You must not seek to recover your bicycle yourself or to confront the person you believe stole it.

Bike Transfers
You may transfer your bike’s registered information and photographs to another registered member of the Australia Bike Vault – Stolen Bicycles Australia. If the person you are transferring to is not a registered member they will first need to create an account to accept the transfer. To initiate the transfer you require the transferees email address. You are responsible for ensuring you obtain the correct email address of the transferee and you are responsible for the information and photographs that you transfer. We recommend prior to transferring that you edit and update your bike’s details and remove the following:
If you are transferring your bike’s registration as a result of a sale, we recommend that you do not action the transfer until the sale is complete and the payment for the bike has settled.

Public Users
When you transfer your bike, the date of transfer, your name and part censored member ID (e.g. Member ID: 103###) will be displayed in the new owner’s Log Book - Transfer History on our website. If the new owner transfers the bike further, the transfer history will continue to update with a record of your prior transfer and your part censored member ID, although your name will no longer be visible to future transferees in the Log Book- Transfer History viewed on our website.

Bike Shop/Commercial Users
When you transfer a bike, the Log Book records the date of transfer and your bike shop’s name/business name, suburb, State/Territory, phone number and your part censored member ID (e.g. Member ID: 103###). This information will remain viewable in the Log Book – Transfer History, no matter how many times the bike is transferred in the future.

Log Book
Certain information and photographs recorded in the Log Book are date-stamped by our system and edits and updates are recorded to reflect the continuity of the information recorded. We do not warrant or verify the accuracy, authenticity or identity of registered users and the information and photographs displayed in the Log Book. If you are looking to purchase a bike registered on our website, we recommend that you conduct thorough due diligence on the purchaser and the bike before proceeding with a purchase. You agree to indemnify us for any claim against us, whether brought by you or a third party, which relates to your use of any information on or from our website relating to the transfer of a registered bike and the information contained in the Log Book.

4. Collection Notice

We collect personal information about you in order to contact you to fulfil our services, which may include contacting you when your bicycle is suspected of being stolen or has been reported stolen and in the event that your bicycle is located and/or recovered and for purposes otherwise set out in our Privacy Policy.

We may disclose that information to third parties that help us deliver our services (including law enforcement agencies when investigating bike theft, information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services to you.

Our Privacy Policy explains: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in the Privacy Policy and these Terms.

5. Accuracy, completeness and timeliness of information

The information on our website is not comprehensive and most of the content is supplied and posted by our registered members. While we use reasonable attempts to ensure the accuracy and completeness of the information we publish on our website, we cannot guarantee the following: To the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this website. You should monitor any changes to the information contained on this website.

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this website or a linked website. You must take your own precautions to ensure that whatever you select for your use from our website is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.

We may, from time to time and without notice, change or add to the website or the information, products or services described in it. However, we do not undertake to keep the website updated. We are not liable to you or anyone else if errors occur in the information on the website or if that information is not up-to-date.

We may, from time to time, amend these Terms. To amend the Terms, we must notify you by email or post a notice on our website.

Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

7. Intellectual property rights

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in this website and in all of the material (including all text, graphics, logos, audio and software) made available on this website (Content).

By posting any material on our website, you warrant that you have the right to post the material and grant us a non-exclusive licence to use the material.

Your use of this website and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to this website or the Content. However we do grant you a licence to access the website and view the Content on the terms and conditions set out in these Terms and, where applicable, as expressly authorised by us and/or our third party licensors. We authorise you to share Content through social media provided that you do so in good faith to help recover a bicycle.

Any reproduction or redistribution of this website or the Content is prohibited and may result in civil and criminal penalties. In addition, you must not copy the Content to any other server, location or support. Publication, reproduction or distribution is expressly prohibited.

All other use, copying or reproduction of this website, the Content or any part of it is prohibited, except to the extent permitted by law.
